In 1896 Walter Wertime Sr. probably did not define himself as an “estate planning lawyer” although that is what he did. Estate planning is the careful manner in which someone manages their estate taxes, avoids probate, and plans to preserve assets in the event of catastrophic medical expenses. Our estate planning attorneys do this by using advance directives, such as a heath care proxy, living wills, durable power of attorney, living trusts and other legal means to help our clients avoid estate taxes, work toward asset preservation, and pass as much of their estate on to heirs while making provisions for their end of life issues.

At Wertime Ries & Van Ullen, most of our New York clients come to us with an idea of what they think they need and what they need to do. During our initial 2-3 hour meeting, we work to discover their entire family picture, and develop an estate plan based upon that initial discussion. Most couples want to work together with their lawyer, but in the situation when most assets such as a business are owned by one spouse this may not be the case. We are sufficiently experienced to handle most situations. Sometimes we suggest that the couple or individual invite another family member. For example, if a couple has two children but only one accompanies them to a meeting, we might suggest bringing the other child to avoid a contested will or other problems in the future.

People have a great many estate planning questions, which we answer. What can I do to avoid probate or estate taxes? How can I protect my assets if I get sick? How can I make sure I won’t be kept alive by life support? What are my obligations if I become the community spouse? Estate planning answers these questions. Keep in mind that doing absolutely nothing is also a plan – one that leaves many of the decisions about your estate in someone else’s hands.
